彭州市规划和自然资源局和彭州市龙门山湔江河谷生态旅游区管理委员会作为主办单位，四川龙门山文化旅游发展有限公司作为承办单位，上海国际招标有限公司作为征集组织机构，现举办彭州市天彭门城市设计方案公开征集活动，拟面向全球公开邀请具有相关设计经验的设计机构前来申请应征，提交资格预审申请文件。通过资格预审选取3名应征人参加征集活动，并提交应征设计方案。
Pengzhou Planning and Natural Resources Bureau and Pengzhou Longmen Mountain Jian River Valley Ecological Tourism Area Management Committee(as the Sponsor), Sichuan Longmen Mountain Culture and Tourism Co., Ltd.(as the Organizer) and Shanghai International Tendering Co. Ltd. (as the Solicitation Agency) are now jointly soliciting Proposals for Urban Design of TianPeng Gate, Peng Zhou. We publicly invite design institutions worldwide with related design experience to participate and submit the Application Documents for Prequalification. Three Participants will be selected through prequalification to participate in the solicitation activities and submit the Design Proposals.
一、 征集背景（项目概况）
The Background of Solicitation（Project Briefing）
为坚定不移贯彻创新、协调、绿色、开放、共享的新发展理念，加快建设践行新发展理念的立体山水公园城市，借力“三九大”核心品牌，着力打造川西旅游集散地，建设山水城镇共融共生的湔江发展带，构建湔江河谷旅游区品牌价值链，打造湔江河谷天彭门品牌，特开展天彭门城市设计方案公开征集活动。
In order to unswervingly implement the new development concept of innovation, coordination, green, openness and sharing, to accelerate the construction of a three-dimensional landscape park city that implements the new development concept, to leverage on the core brands of the "SanJiuDa" and strive to build Western Sichuan as a tourist distribution center, to build a development belt of Jian River where landscapes and towns are in harmony, to build a brand value chain for the tourist area of Jian River Valley, to build TianPeng Gate brand of Jian River Valley, we especially launch a public solicitation of Proposals for Urban Design of TianPeng Gate.

通过资格预审，择优选取3个应征人（含联合体应征人）参加征集活动，并提交应征设计方案。

评审委员会对应征设计方案进行评审，并出具推荐意见。

1.1 总体策划范围
General Planning Scope
总体策划范围包括丹景山景区及周边的山林、水体、湿地等区域，总面积约17平方公里，具体范围见附图（范围可微调）。
The general planning scope includes Danjing Mountain scenic area and surrounding forest, water, wetland and other areas, with a total area of about 17 square kilometers. See the attached figure for the specific scope (submitted to be fine tuned).
1.2 城市设计及核心区范围
Urban Design and Core Area Scope
城市设计范围北至止马岛南侧，南至S106道路，西至原彭白铁路，东至湔江路（范围线按道路边线外移约100米），总面积约5平方公里。
The urban design covers an area of about 5 square kilometers from the south of Zhima Island in the north, S106 road in the south, the original Pengbai railway in the West and Jianjiang road in the East (the boundary line is moved about 100 meters according to the side line of the road).
在城市设计范围中，在满足土地利用规划前提下，在有条件区域选择不少于1平方公里的区域作为核心区，进行修建性详细规划深度的城市设计。
In the scope of urban design, under the premise of satisfying land use planning, the area of not less than 1 square kilometer will be selected as the core area in the qualified area, and the urban design in the depth of site plan will be carried out.
1.3 设计阶段
Design Stage
本次方案征集分为征集阶段、深化设计阶段和后续咨询服务三个设计阶段。

征集阶段：3家入围设计机构需完成总体策划、总体城市设计及重要节点概念设计方案。

Development design stage: On the basis of the design results of the previous stage, the winner will optimize the scheme combining with the highlights in the other two shortlisted agencies, deepen the general planning, urban design and conceptual design of important nodes, and complete the detailed urban design of core area, the scheme design of important nodes and the implementation guidelines of planning and construction.
后续咨询服务阶段：1家中选机构需提供天彭门区域后续2年的咨询服务。

七、 应征申请人资格要求
Eligibility and Qualifications of Participating Applicants
1. 应征申请人（以下简称“申请人”）应为合法注册的法人实体或由合法注册的法人实体组成的项目联合体；
The participating applicant (hereinafter referred to as the “Applicant”) shall be a legal entity that has been legally incorporated in accordance with laws or a project consortium composed of legal entities that have been legally incorporated in accordance with laws;
2. 申请人应具有承担本城市设计项目的相关资格及能力：
The Applicant shall have the relevant qualifications and abilities to undertake the urban design project:
2.1 申请人为境内机构:需提供企业法人营业执照，风景园林工程设计专项甲级资质证书，以及城乡规划编制甲级或建筑行业（建筑工程）设计甲级资质证书，法人授权委托书及委托代理人身份证；
The domestic applicants shall provide business license, a qualification certificate of Grade A landscape design and, a qualification certificate of Grade A urban and rural planning or architectural design (architectural engineering), Power of Attorney of Legal Representative and authorized agent’s ID card;
2.2 申请人为境外机构（含港、澳、台机构）（不可作为独立申请人，须与境内机构组成联合体）：需提供所在国或地区核发的合法营业及设计许可、授权委托书及委托代理人身份证明文件、联合体协议书；
The overseas applicants (including applicants in Hongkong, Macao and Taiwan) shall provide a business license or practice license, Power of Attorney of Legal Representative and authorized agent’s ID card and Consortium Agreement;
2.3 境外机构须依本国或本地区的管理规定具有风景园林设计以及城市规划或建筑设计或的执业许可或经营许可。若依该国或该地区有关风景园林设计、城市规划和建筑设计从业或营业的管理规定风景园林设计、城市规划或建筑设计企业法人应具有相应执业资质或资格或营业许可，则需提供该机构的相应资质或资格或营业许可证明文件；若依该国或该地区有关风景园林、规划、建筑设计从业或营业的管理规定，不要求风景园林设计、城市规划或建筑设计企业法人具有相应执业资质或资格或营业许可，仅对规划师、建筑师、景观设计师个人要求具有相应资质或资格或执业许可，则需提供该机构的景观设计师、规划师、建筑师本人的注册或执业证书或会员证明材料，同时设计机构应说明该国或该地区有关风景园林设计、规划和建筑从业或营业的管理规定；
The overseas applicants should have a practice license or business license for landscape design and, urban planning or architectural design in accordance with the national or local administrative regulations. If a business entity engaged in landscape design, urban planning or architectural design should have the corresponding practice permit or qualification or business license according to the national or local administrative regulations on practice or operation of landscape design, urban planning and architectural design, it shall provide documentary evidence for its practice permit or qualification or business license. If the national or local administrative regulations on practice or operation of landscape design, urban planning and architectural design do not require that a business entity engaged in landscape design, urban planning or architectural design should have the corresponding practice permit or qualification or business license, and only require that landscape architects, planners and architects should have appropriate qualifications or practice licenses, then the registered or practicing certificate or membership certificate of the landscape architect or planner or architect of the institution should be provided, and the design agency should explain the national or regional administrative regulations on practice or operation of landscape, planning and architectural design;
3. 本项目接受联合体申请，联合体的成员机构不得超过3个；
This project accepts applications from Consortium, and the number of the Consortium members shall not exceed three;
3.1 联合体的各成员应共同签署一份联合体协议；
Members of the Consortium shall jointly sign a consortium agreement;
3.2 组成项目联合体的各成员单位不得再以自己的名义单独申请资格预审，也不得同时加入本项目其它联合体申请资格预审；
Any partner of the Consortium shall neither individually apply for the Prequalification in its own capacity, nor concurrently apply for the Prequalification as a partner of another Consortium;
3.3 境外设计机构不可作为独立申请人，须与境内机构组成联合体；若联合体均由境内设计机构组成，则需满足2.1项要求；若联合体由境内、外设计机构（包括港澳台地区）组成，则境内机构须满足2.1项要求，境外机构（包括港澳台地区）需满足2.2项要求。
Overseas design agency cannot apply as independent applicant, instead, it should apply as Consortium with domestic agency. If the Consortium is composed of domestic design agencies, the requirements in Item 2.1 shall be met; if the Consortium is composed of domestic and foreign design agencies (or design agencies from Hong Kong, Macao and Taiwan), the domestic agencies shall meet the qualification requirements in Item 2.1, and foreign agencies (or agencies from Hongkong, Macao and Taiwan) shall meet the requirements in Item 2.2. 
八、 报名登记与资格预审文件的获取
Registration and Obtaining of Prequalification Documents
1. 请申请人于2020年9月11日10:00时（北京时间，下同）至2020年9月17日16:00时在上海国际招标有限公司网站(https://www.shabidding.com)注册并在线领取资格预审文件。网站首次注册需要上传的材料包括：《注册专用-供应商注册专用授权函和承诺书》（可从供应商注册页面或供应商补全信息流程页面下载，注册手机号即为供应商登录主账号，该手机号所有人应为被授权办理供应商注册和主账号登录管理的合法代理人）、供应商注册证明、基本存款账户开户证明和基本存款账户信息等原件扫描件。申请人应当提前准备。网站注册审核需1个工作日，请尽早办理，以免影响领取资格预审文件。已注册的申请人可从网站采购公告栏的相应公告中进入在线领取资格预审文件流程。
The applicant is requested to register and receive the prequalification document online through the website of Shanghai International Tendering Co., Ltd. (https://www.shabidding.com) from 10:00, September 11, 2020 (Beijing time, the same below) to 16:00, September 17, 2020. The website registration document includes: Special Authorization and Commitment Letter for Supplier Registration (Document can be downloaded from the supplier registration page or supplier completion information process page. The registered mobile phone number is the supplier's main login account. The owner of the mobile number shall be the legal agent authorized to handle supplier registration and main account login management), supplier registration certification, scanned original copies of the basic deposit account opening certificate and the basic deposit account information. Applicants should prepare in advance. Website registration verification takes one working day, please register in advance to prevent failure of receiving the prequalification document. Instructions on Solicitation
1. 应征设计补偿金
Compensations for Designs Proposals
承办单位将向按照征集要求提交了有效的方案及应征文件的应征人支付应征设计补偿金，金额为人民币150万元（含税）。
The Organizer will pay a compensation for Design Proposal to each of the three Participants who have submitted valid proposals in accordance with the solicitation requirements. The amount is RMB 1.5 million (including taxes).
2. 当应征人出现下列情况时，承办单位不予支付补偿金：
The Organizer will not pay any compensation when Participants are under the following circumstances:
2.1 应征人未按规定时间提交应征文件；
Participants fail to submit the Design Proposals within the specified time;
2.2 应征人提交的应征文件经专家评审被认定为未对征集文件要求作出实质性响应；
The Design Proposals submitted by Participants are judged, upon the expert review, as not substantially responding to the requirements of the solicitation documents;
2.3 应征人被取消应征资格；
Participants are disqualified;
2.4 方案征集期间，应征人的资格条件发生变化，不能达到第七条规定的应征人资格要求。
During the period of solicitation, the qualification conditions of the Participants have changed and cannot meet the requirements of Article 7 Eligibility and Qualifications of Participants.
3. 深化设计费用：
Development Design Fee:
本次方案征集设1家中选设计机构，最终中选的设计机构，将与承办单位签订后续深化设计合同，合同金额550万元人民币（含税）。
There is1 winner in the public solicitation. The organizer and the winner will sign a following development design contract with total amount of RMB 5.5 million (including taxes).
以上费用含中国境内、外应缴纳的各项税费。
The above fees include all taxes payable within and outside China.

1. 知识产权
Intellectual Property Rights (IPR)
1.1 本次方案征集中接收的所有有效的应征设计成果均不退回。
All valid Design Proposals received in this solicitation will not be returned.
1.2 应征人提交的应征城市设计版权均归主办单位/承办单位所有。应征人对其应征的城市设计享有署名权。在征得主办单位/承办单位书面同意后，应征人可通过传播媒介、专业杂志、书刊或其他形式评价、展示其应征设计成果的相关内容。除应征人的设计标准、设计导则和绘图元素以外，应征人不得将应征设计成果用于其他的规划设计项目。
The copyright of the applied urban design submitted by Participants belongs to the Sponsor / Organizer, and Participants hold the right of authorship for the applied urban design. Participants can comment on and display the relevant contents of Design Proposals in the forms of media communication, trade magazines, and publications among others upon the Sponsor’s / Organizer’s consent in writing. Except for Participants' design standards, designing guidelines and drawing elements, the Participants shall not use their Design Proposals in other planning and design projects.
1.3 应征人提交的应征建筑方案版权归主办单位/承办单位及应征人共有。主办单位/承办单位可对应征建筑方案进行印刷、出版和展览，可通过传播媒介、专业杂志、书刊或其他形式评价、展示、宣传，但应注明应征建筑方案的设计单位和创作者。在征得主办单位/承办单位书面同意后，应征人可通过传播媒介、专业杂志、书刊或其他形式评价、展示其应征建筑方案的相关内容。
The copyright of the architectural design scheme submitted by Participants belongs to the Sponsor / Organizer and the Participants. The Sponsor / Organizer can print, publish and exhibit the guidance, and can comment on, display and publicize it in the forms of media communication, trade magazines, publications among others, but should indicate the design organizations and creators of the guidance. Participants can comment on and display the relevant contents of the architectural design scheme in the forms of media communication, trade magazines, and publications among others upon the Sponsor’s /Organizer’s consent in writing.
1.4 主办单位/承办单位有权在本项目的规划编制、城市设计编制、城市设计导则编制、建筑方案编制、城市运营、园区商业运营、土地出让、规划建设管理等情形中无偿全部或部分使用应征人提交的设计成果。
The Sponsor / Organizer has the right to use all or part of the Design Proposals free of charge in the formulation of the planning, urban design, urban design guidelines, and architectural proposal guidance as well as urban operation, Park commercial operation, land transfer, planning and construction management of the project.
1.5 应征人应保证提交的应征设计成果在中国境内或境外没有且不会侵犯任何其他人的知识产权（包括但不限于著作权、专利权）或专有技术或商业秘密。应征人应保证，如果其应征设计成果使用或包含任何其他人的知识产权或专有技术或商业秘密，应征人已经获得权利人的合法、有效、充分的授权。应征人因侵犯他人知识产权或专有技术或商业秘密所引起的全部赔偿责任（包括但不限于：第三方的赔偿款、主办单位/承办单位损失、律师费、诉讼费、保全费、担保费等）应由应征人承担。
Participants shall ensure that all the submitted Design Proposals have not infringed upon and will not infringe upon IPR (including but not limited to copyright and patents) or proprietary technologies or trade secrets of others within or outside the People’s Republic of China. Participants shall guarantee that if their Design Proposals use or include IPR or proprietary technologies or trade secrets of others, Participants shall have already obtained legitimate, valid and sufficient authorization from the right holders. Participants shall take all liabilities arising from infringement by the Participants upon IPR or proprietary technologies or trade secrets of others.
1.6 在征集过程中主办单位提供的设计基础资料（包括设计图纸、设计资料等）的知识产权属主办单位及相关设计单位所有。应征人仅可以将上述文件用于应征设计和编制应征设计文件之目的。未经主办单位书面许可，应征人不得将上述文件用于其他工程设计或其他目的，也不得将上述文件泄露给任何第三方。
The IPRs of the basic design information (including design drawings, design materials, etc.) provided by the Sponsor during the solicitation process belong to the Sponsor and related design organizations. Participants can only use the documents aforementioned for the purpose of designing and compiling Design Proposals. Without written consent from the Sponsor, Participants shall not use the documents aforementioned for other engineering designs or other purposes, and shall not disclose the documents aforementioned to any third Party.
2. 适用法律
Governing Laws
本次征集活动本身及与本次活动相关的文件所适用的法律和法规仅为中华人民共和国的法律和法规。
The solicitation per se and any documents relating thereto shall be governed only by the laws and regulations of the People’s Republic of China.
3. 语言
Languages
3.1 资格预审文件以及与资格预审文件相关的补充文件和澄清文件均同时使用中文和英文书写。在中、英文两种语言的意思表达不一致时，以中文为准。
The language used in the Prequalification Documents and any supplement and clarification documents thereto shall be Chinese and English. In the event of any discrepancy between Chinese and English, Chinese shall prevail.
3.2 资格预审申请文件与主办单位之间与征集活动有关的往来函电和文件均应使用中文书写。应征人随应征文件提供的证明文件和印刷品可以使用另一种语言，但必须附以中文译本。
Application Documents for Prequalification and the correspondence and documents related to this solicitation between Participants and the Sponsor shall all be drafted in Chinese. Another language can be used for the proof documents and printed materials that Participants provide along with the application documents, but the version with Chinese translation shall be attached thereto.
3.3 与本次征集活动相关的会议及各项活动的口头交流的语言为中文。
The language used in the meetings and oral communication related to this solicitation shall be Chinese.
4. 解释权
Power of Interpretation
本次征集活动及相关文件的最终解释权归主办单位。
The final right of interpretation of the solicitation and related documents is held by the Sponsor.
